Callahan v. Harris - The Baby Name Change Saga

What happens when parents cannot agree on their baby’s last name?

While a Texas divorce was pending, a mother gave birth, left the father’s section of the birth-certificate paperwork blank, and ...chose a surname that neither parent had at the time. The father learned he had been omitted when he requested a copy to enroll the baby in insurance. He then asked the court to give the child his surname.

The trial court agreed, and the appellate court affirmed. Neither parent has a sole constitutional right to choose a child’s name. The controlling question is the child’s best interest—not tradition, who completed the paperwork, or which parent can count more favorable facts.

Here, the court could consider the child’s young age, the short time the original surname had been used, the mother’s unilateral decision, the father’s involvement after birth, and conflicting testimony about whether the parents had previously agreed on a name.

The court also upheld a possession schedule that did not match the schedule of an older half-sibling. Alignment mattered, but it did not automatically control the broader best-interest decision.
